Judge Andrew Napolitano told Fox News on Wednesday that President Trump will not be able to force the hand of mayors in sanctuary cities by withholding federal funding – until October.
“That is what the Seattle loss is about,” the Judge told a live TV audience. “Seattle argues, quite properly, that the federal government can’t claw the money back. Local law enforcement is not bound to help the Federal government catch undocumented immigrants, but it can’t actively hide them.”
Mayors have not agreed, Napolitano states, to receive Federal funds in exchange for changing their policy toward illegal immigrants.
However, that will change in October. “President Trump and the Congress can get their way, but only with the money that starts with next October, not with the money that has started last October,” says Judge Nap.
