Emily Lofing, 27, made headlines as the married Nebraska school teacher, who gave her 16-year-old student sex as a birthday present.
Lofing was sentenced earlier this week to just 90 days in prison. She was originally charged with a misdemeanor of debauching a minor in February. The charge was later changed. Due to the minor being over the age of consent, the new charge she will be jailed for is considered contributing to the delinquency of a child.
Prosecutors say that she will be able to get out after 53 days, as long as she has good behavior.
The Daily Mail reports:
With good behavior, she could be released from prison in 53 days.
The 27-year-old former English teacher at Nebraska City Middle School pleaded no contest to the charge, WOWT reports.
Lofing was not given a lengthier sentence due to Nebraska state law allowing any 16 year-old to consent to sex.
Otoe County Court Judge John Steinheider mentioned the consent law when handing down his sentence.
‘This alleged indiscretion, I’ll say, took place on the victim’s 16th birthday,’ Judge Steinheider said.
‘You were less than 24 hours from a felony here.’
Lofing’s lawyer pleaded with the judge to show leniency for his client.
The student’s mother was the one who reported the abuse to the authorities. She feared that the teacher was sleeping with her son.
She detailed her concerns in an email to the police. After an investigation. Lofing admitted her crimes.
