A South Carolina man has been sentenced to 15 years in prison for raping an 82-year-old woman for 12 hours in 2006.
On Wednesday, 30-year-old Brandon Vernard Johnson was sentenced to serve 15 years behind bars after pleading guilty to first-degree criminal sexual misconduct.
According to police, Johnson had walked through the victim’s unlocked front door and sexually assaulted her for 12 hours. Police were called after the neighbors heard strange sounds and went to check on the woman.
In 2008, a jury could not reach a verdict and the case ended in a mistrial.
Back in 2008, Johnson claimed that the sex was consensual and he was drunk. The jury deliberated for two days and could not reach a verdict.
The victim could not testify against him because she suffers from Alzheimer’s disease. Prosecutors were able to use her statements from the night of the incident, though, including her calling Johnson a “sick son of a bitch” when police questioned her.
Johnson was arrested near her home wearing one of her shirts. He claimed to have run out of the house because “the appearance of a young black man having sex with an older white woman didn’t look good.”
Defense attorney Beattie Butler said “a significant number of jurors thought Brandon was not guilty.” A juror said the deliberations were “close, very close.”
The jury had asked the judge to give them the option of a lesser charge, saying they might be able to reach a verdict on simple battery but the judge declined and declared a mistrial.
This time around the defendant pleaded guilty and got 15 years, compared with the maximum 30 years he may have gotten if the case went to trial again.
