Deborah and Ariel Levy say that had they known their child would be born with a Chromosomal abnormality, they would have had an abortion. And they are holding the maternity center liable for a misdiagnosis of this condition. The center is called Legacy Health and is located in Portland, Oregon.
The daughter, named Kalanit, was born in 2007. After the birth, a blood test had confirmed she was born with Down Syndrome.
A previous Oregonian report said the Levys were initially seeking $14 million to cover the cost of raising their daughter, including for education, medical care and other therapies. The Levys’ lawyer said the couple have received death threats and the judge overseeing the case has banned courtroom photos of them for safety reasons.
This is pretty sad for a child’s parents to say they would have rather had her aborted than raise her. And sad for the maternity center that is now forced to spend money defending themselves.
Should this case be thrown out as a frivolous lawsuit or should the maternity center be held liable?
