Representative Walter B. Jones Jr. of North Carolina has introduced an impeachment resolution before Congress.
What is the impeachable offense according to the resolution? Using military force without the authorization from Congress.
Here is what is stated in the House Concurrent Resolution 107:
Expressing the sense of Congress that the use of offensive military force by a President without prior and clear authorization of an Act of Congress constitutes an impeachable high crime and misdemeanor under article II, section 4 of the Constitution.
Tancredo says Jones had introduced this in response to Panetta’s comments.
Here is what Panetta said:
“Our goal would be to seek international permission and we would come to the Congress and inform you…”
Saying that you would seek permission from an international body and not the Congress is considered impeachable, according to the resolution.
This is not the only time when Obama ignored the Constitution with respect to war. Obama was quick to go into Libya and declared that he was in the right to do so even without Congressional approval.
They ought to add the fact that we are allowing NATO and Afghanistan to be in charge of whether or not our troops are on trial.
My understanding is that this would only set the ground work for what is impeachable with respect to using force. It does not directly impeach the President if passed because it does not specifically name President Obama. That being said, Fox News entitled their article “Obama Impeachment Bill”. Perhaps the next step after having this resolution passed is to impeach Obama. Not sure.
