Fox News reported on Wednesday that a federal appeals court decided that the federal government’s ban on the sale of firearms to medical marijuana card holders does not violate the Second Amendment.
The 9th Circuit Court of Appeals upheld a ruling in a lawsuit brought by a Nevada woman, S. Rowan Wilson, who was unable to purchase a firearm because she had a medical marijuana card.
California, Oregon, and Washington are three of the nine states under the jurisdiction of the 9th Circuit Court of Appeals and therefore affected by this ruling.
Those with medical marijuana cards are assumed to be using the drug, which is illegal n the federal level – and it is illegal to sell firearms to illegal drug users.
The Bureau of Alcohol, Tobacco, Firearms and Explosives made it clear to gun sellers that if someone has a medical marijuana card that they are then able to assume the person uses the drug.
Fox News said the following:
“The 9th Circuit in its 3-0 decision agreed that it’s reasonable for federal regulators to assume a medical marijuana card holder is more likely to use the drug.
In addition, a ban on the sale of guns to marijuana and other drug users is reasonable because the use of such drugs ‘raises the risk of irrational or unpredictable behavior with which gun use should not be associated,’ Senior District Judge Jed Rakoff said.”
The 9th Circuit also rejected other constitutional challenges to the ban that were raised by Wilson.”
This denial of Second Amendment rights may be disproportionately applied to liberals, although there are people with legitimate reasons for having a medical marijuana card on both sides of the political fence.
Regardless of your stance, this does seem like a case where commonsense and the legal system don’t exactly mesh well.
Then again, if you are against the legalization of marijuana, this may not affect you. Those that are for the legalization would point to the hypocrisy of he reasoning and the denial of Second Amendment Rights based on it.
No matter your stance, if you support the Second Amendment, it is important to be wary any time the government encroaches on it.
